GENERAL REGULATION AND PRIVACY POLICY

  1. GENERAL REGULATION

Store regulations valid from December 1, 2023.

I. General information:

The following regulations govern the rules for placing Orders on the Silvercoins Europe Online Trading Platform www.silvercoinseurope.com.

Whenever the regulations mention:

Seller: this means the SILVERCOINS EUROPE ISTOC & FERNANDEZ SPÓŁKA JAWNA (hereinafter Silvercoins Europe) with its registered office in Ostrowiec Świętokrzyski (27-400) at ul. Nowe Piaski 10, entered into the register of associations kept by the District Court for Wrocław-Fabryczna in Wrocław, VI Commercial Division of the National Court Register under the number: 0000978101, National Businnes Registry Number (REGON) 522360616, Tax Identification Number (NIP): 8992928783.

Buyer – this means a natural person (with at least limited legal capacity and at least 18 years of age), as well as a legal person or an organizational unit without legal personality, with legal capacity and capacity to perform legal acts.

Trading Platform – this means the online Trading Platform operated by the Seller at the Internet address www.silvercoinseurope.com.

Goods – this means goods offered by the Seller for retail sale on the Trading Platform.

Net price – this should be understood as the price excluding VAT, expressed in euro, excluding the costs of delivering the Goods.

Gross price – this should be understood as the price including VAT expressed in euro, excluding the costs of delivering the Goods.

Suppliers – this should be understood as the Courier Companies cooperating with the Seller specified in the Regulations.

Costs of delivering the Goods – this means the fees for delivering the Goods to the Buyer. These amounts are displayed on the Store’s website when the Buyer places an order for the Goods.

Order – this means a set of Goods specified for execution by the Buyer in electronic form, in accordance with these regulations.

II. Registration and ordering conditions:

  1. To use the services of www.silvercoinseurope.com by the Buyer, Internet access, an active e-mail account and a contact telephone number are required.
  2. By registering an Account, the User declares that: has read the Regulations and accepted its content in its entirety, meets the conditions required to use the Trading Platform specified in the Regulations.
  3. The User is obliged to keep the password to access the Account secret. The User is obliged to exercise the utmost care to prevent the loss of the access password or its accession by third parties (regardless of the method). The User is solely responsible for providing the login and password to third parties.
  4. The User may delete his/her Account at any time. Deleting the Account results in permanent and irreversible deletion of all User data from the system. The customer may send declarations of termination of the contract for the provision of services electronically to the e-mail address: info@silvercoinseurope.com. Termination of the contract for the provision of electronic services has no effect in relation to concluded sales contracts unless the store and the customer agree otherwise.
  5. Placing an order and making purchases is related to the correct completion of the registration form (in particular, providing the personal data required in the form, contact number, e-mail address – later used as a login – and setting a password), expressing consent by the Buyer to conclude a sales contract and read the regulations of the Silvercoins Europe Trading Platform.
  • Registration is done once. Subsequent Orders are placed by providing a login (e-mail) and password.
  • The password and login are confidential.
  1. The Buyer places an Order on the website of the Trading Platform. The Seller sends the Buyer a link to confirm the Order via e-mail.
  1. The Seller reserves the right to additional verification of the Buyer’s data, e.g., by e-mail.
  1. The sales contract is concluded when the Seller confirms acceptance of the Order for execution by sending the Buyer an e-mail with the Order number.
  1. The Seller has the right to refuse to process Orders: submitted on an incorrectly completed form, after an unsuccessful attempt to confirm the Order, submitted in violation of these regulations.
  1. Orders can be placed on the Trading Platform 24 hours a day, all days of the year, and their execution takes place on business days (Monday to Friday, 8:00 a.m. – 5:00 p.m.).
  1. The Seller does not process Orders on public holidays in accordance with applicable regulations.
  1. The gross price of the Goods is posted on the website of the Trading Platform next to the information about the Goods.
  1. There is no minimum order value.
  1. Direct contact between the Buyer and the Seller is possible using the form on the website or by the e-mail received after placing the Order.
  1. The sales document is a fiscal receipt or a VAT invoice.
  1. The Seller delivers the Goods to the Buyer together with a sales document in the form of a fiscal receipt or VAT invoice.
  1. If there is a shortage of the Ordered Goods, the Seller will inform the Buyer about this fact before executing the Order, and the Buyer has the right to cancel the entire Order or to give up the Goods.
  1. The Buyer undertakes to collect the Goods and pay the Price indicated by the Seller along with the Costs of delivering the Goods.
  1. The terms of the sales contract are specified in these regulations, applicable legal provisions and individual arrangements between the Seller and the Buyer.
  1. The Seller is liable for defects in the Goods, the regulation of this liability is contained in the provisions of the Civil Code, in particular in Art. 556 and art. 5561-5563KC.
  1. The price given for each product is binding at the time the Buyer places the order.
  1. The Trading Platform reserves the right to change the prices of goods included in the Trading Platform’s offer, introduce new goods to the Trading Platform’s offer, conduct and cancel promotional campaigns on the Trading Platform’s websites or make changes to them. The above right does not affect the prices of goods in orders placed before the date of entry into force of the price change, terms of promotional campaigns or sales.
  1. The costs of returning the replaced product to the Silvercoins Europe and the cost of re-shipping the product to the Buyer are covered by the Buyer.
  1. The seller does not accept shipments sent cash on delivery.

III. Payment rules:

The current payment methods available on the Trading Platform are specified on the Trading Platform website. Possible payment methods are:

  • Payment by traditional transfer to the Seller’s bank account;
  • Payment by credit card via the online payment system Paynow.

IV. Delivery:

  1. The Seller guarantees delivery of the Goods throughout the world.
  2. There is no minimum order amount.
  3. Delivery in Poland is made through Pocztek with delivery directly to the customer’s door. Outside Poland, all deliveries are made via UPS.
  4. The methods, costs and area of delivery of the Goods are provided on the Trading Platform website when placing an Order.
  5. For shipments to Poland, for a purchase under 500 PLN, shipping costs are 19 PLN. For orders to Poland, for orders over 500 PLN, the shipping costs are charged to Silvercoins Europe.
  6. In case of absence of the Buyer at the address indicated in the Order, the Supplier shall contact you to arrange a new delivery date. In case of repeated non-deliveries due to the Buyer’s fault, the Buyer may be charged for the cost of the non-deliveries.
  7. Upon delivery of the goods, the Purchaser shall check, in the presence of the Supplier, whether the shipment is free of transport damage, whether it is intact, whether it conforms to the Order and confirm receipt of the Order to the Supplier.
  8. If the shipment is found to be damaged, incomplete or inconsistent with the Order, the Buyer is asked not to accept the shipment and to immediately report this fact to the supplier of the Goods in order for the Supplier to prepare a return report.
  9. In the event of a delay by the Seller, the Buyer may set an additional deadline for handing over the goods, and after its ineffective expiry, the Buyer may withdraw from the contract.
  10. The order processing time is counted from the moment of obtaining positive payment authorization.

V. Right to withdraw from the contract:

  1. Pursuant to Art. 27 of the Act of May 30, 2014, on consumer rights, the Buyer who is a consumer has the right to withdraw from the contract within 14 days from the date of receipt of the Goods. To meet this deadline, it is enough to inform us about your decision to withdraw from the sales contract via e-mail to the following address: info@silvercoinseurope.com before its expiry.
  1. In the event of withdrawal from the contract as indicated in point. 1 above, the contract for the sale of the Goods is deemed not to have been concluded. If the right of withdrawal is exercised, the Goods should be returned to the Seller in accordance with the provisions of law within 14 days of submitting the declaration of withdrawal from the contract of sale of the Goods.
  1. The Seller shall immediately send the Buyer confirmation of receipt of the declaration of will withdraw from the sales contract to the e-mail address provided by the consumer.
  1. In the event of withdrawal from the sales contract for the Goods, the Buyer may return the Goods by sending them to the following address of the Silvercoins Europe based in Ostrowiec Świętokrzyski 27-400 at ul. Nowe Piaski 10. The returned Goods must be accompanied by proof of purchase.
  1. The direct costs of returning the Goods are borne by the Buyer. The Seller bears the costs of returning the Goods only if the Seller has previously agreed to incur the above-mentioned costs.
  1. The Goods returned by the Buyer should be packaged in an appropriate manner to ensure no damage during transport. The Buyer is liable for any reduction in the value of the Goods resulting from using it in a manner that goes beyond what is necessary to establish the nature, characteristics and functioning of the Goods. In such a case, the Seller may return to the Buyer the amount of the value of the Goods but reduced by the amount corresponding to the reduction in the value of the Goods.
  1. The Seller will immediately, but no later than within 14 days from receiving the Buyer’s declaration of withdrawal from the contract, refund to the Buyer all payments made for the Goods covered by the declaration of withdrawal and the costs of delivering these Goods, if they were incurred by the Buyer. The Seller may withhold the refund until receipt of the Goods or until proof of their return is provided, depending on which event occurs first.
  1. Returned Goods will be assessed in terms of the absence of traces of use, possible damage, possible absence or damage of the original packaging, and the absence of any elements included in the product. In case of deficiencies in the above elements, the Seller has the right to refuse to accept the returned Goods.
  1. The payment will be refunded using the payment method used by the Buyer unless the Buyer has expressly agreed to a different method of return that does not involve any costs for him.
  1. Pursuant to Art. 38 section 1 of the Act of May 30, 2014, on consumer rights, the Buyer is not entitled to withdraw from the Agreement when purchasing the following products: the subject of which is an item that deteriorates quickly or has a short shelf life, the subject of which is a service, if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the provision began that after the entrepreneur has completed the service, he will lose the right to withdraw from the contract the subject of which are items which, after delivery, due to their nature, are inseparably connected with other items.
  2. If the Buyer exercises the right to withdraw from the contract for the sale of Goods after submitting a request for the Seller to start providing the service before the deadline for withdrawal from the contract, the Buyer will be obliged to pay for the services provided until the withdrawal from the contract.
  1. The right to withdraw from the contract does not exclude the Buyer’s rights arising from the Seller’s liability for defects in the Goods.

VI. Personal data protection:

  1. By registering on the Trading Platform, the Buyer consents to the collection and processing by the Seller of personal data provided in the personal data form within the meaning of the Act of August 29, 1997 on the protection of personal data (consolidated text, Journal of Laws No. 101 of 2002)… item 926, as amended) and of July 18, 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended). Personal data is used only for the purpose of concluding, implementing or terminating the contract for the sale of Goods. The administrator of personal data is the Seller.
  1. The Buyer has the right to view the content of the provided personal data and correct it, as well as request the deletion of the data. The Buyer submits such a request via e-mail to the following e-mail address: info@silvercoinseurope.com.
  1. The Buyer may consent to receiving advertising and commercial information from the Seller, including by means of electronic communication. This is done by the Buyer granting consent to the processing of personal data for marketing purposes (receiving the newsletter, receiving information about discounts, promotions, etc.).

VII. Service:

  1. To use the Website it is necessary for broadband internet connection, web browser (Internet Explorer 8 and newer, Google Chrome 15 and newer, Mozilla Firefox 7 and newer, Opera 11 and newer) supporting CSS and JavaScript, cookie support enabled, pop-up windows support enabled, operating system Microsoft Windows XP, 7 or Vista and newer, active email account.
  2. The Seller takes ongoing actions to improve the quality of the Website but reserves that errors and technical problems may occur when using it. If such a situation occurs, the Buyer should report it to the Seller via e-mail info@silvercoinseurope.com. The Seller will immediately attempt to restore the proper functioning of the Website.
  1. The Seller is not responsible for incompatibility of the Website with the Buyer’s final hardware and software or with its connection to the public Internet; technical difficulties, including errors and failures in connecting to the Website, which are the responsibility of the Buyer. All content posted on the Website, including trademarks, photos, descriptions and applications are subject to legal protection. Any use of them in whole or in individual parts constitutes a violation of the law.

VIII. Providing services electronically:

  1. As part of the Trading Platform, the Seller provides services to Buyers electronically. Services provided electronically for the purposes of these Regulations include, in particular, services such as:
  • Making these Regulations available on the website of the Trading Platform,
  • Enabling Buyers to place orders via the Trading Platform website,
  • Enabling Buyers to register user accounts on the Trading Platform and maintain these accounts,
  • Enabling communication between the Seller and Buyers via the website of the Trading Platform,
  • The Buyer receives a newsletter, information about discounts or promotions via e-mail.
  1. The contract for the provision of electronic services is concluded when the Buyer displays the website of the Trading Platform or when the Buyer registers in accordance with point II.
  1. Services provided electronically are free of charge and are provided by the Seller only to the extent necessary for Buyers to make purchases in the Store and use the website of the Trading Platform.
  1. The contract for the provision of electronic services is concluded for an indefinite period.
  1. The Buyer has the right to terminate the contract for the provision of electronic services at any time by leaving the website of the Trading Platform, and in the case of registered Buyers – by deleting the Buyer’s account.
  1. The use of electronic services described in this paragraph may involve a risk on the part of the Buyer as an Internet user. The risk associated with the use of services provided electronically consists in particular in the risk of infecting the Buyer’s IT system with software aimed at e.g., spying on use, stealing important data, causing the system to be unable to run, spam, deleting data, etc. To avoid the mentioned threats above, the Buyer should purchase an anti-virus program and update it regularly.
  1. The Seller informs that the IT system of the Trading Platform may use the so-called “Cookies”, i.e., small text files that are used to identify the user’s browser for statistical and sales analysis purposes. Cookies are not used to collect personal data and are harmless to your computer, software and data. Disabling cookies is possible by changing the settings of the Buyer’s web browser and does not prevent the use of services provided electronically.

IX. Complaint and return of goods:

  1. If the delivered goods are found to be missing or defective, in order to start the complaint procedure, the Buyer should submit a complaint by post to the following address: SILVERCOINS EUROPE ISTOC & FERNANDEZ SPÓŁKA JAWNA w Silvercoins Europe based in Ostrowiec Świętokrzyski 27-400 at ul. Nowe Piaski 10, or via e-mail to: info@silvercoinseurope.com.
  1. When submitting a complaint, the Buyer should provide his contact details (name and surname, address, e-mail address and telephone number), the name of the Goods complained about, the date of its receipt and a possibly detailed description of the identified problem and his request.
  1. In the absence of any of the above. data, the Seller will contact the Buyer to complete the complaint.
  1. If the complaint concerns the quality of the product, the Seller has the right to ask the Buyer to send the questioned product at the Seller’s expense in order to carry out explanatory activities.
  1. The complaint will be considered within 14 days from the date of its submission by the Buyer. The Buyer will be informed about the method of its consideration by the Seller via e-mail.

X. Final Provision:

  1. In all matters not regulated in the above regulations, the provisions of the Civil Code and other acts shall apply, and in relation to consumers, also the Act on Consumer Rights of May 30, 2014 (Journal of Laws of 2014, item 827). The provisions of the Regulations should be interpreted in a way that ensures their compliance with applicable law.
  1. The court competent to resolve any disputes that may arise as a result of the implementation of the provisions of these Regulations is the court competent for the place of residence of the consumer. If the Buyer is not a consumer, the competent court will be determined based on the provisions of the Code of Civil Procedure regarding the subject matter and local jurisdiction of the courts.
  1. The Seller is entitled to make changes to the regulations with future effect. The changes may not violate the Buyer’s rights arising from Orders placed before the changes were introduced.

  1. How do we secure your data?

The administrator has applied technical and organizational measures to ensure the protection of processed data in accordance with the requirements specified in the applicable provisions on the protection of personal data. In particular, the following was taken into account: the Regulation of the Minister of Internal Affairs and Administration of April 29, 2004 on the documentation of the processing of personal data and the technical and organizational conditions to be met by devices and IT systems used for the processing of personal data (Journal of Laws No. 100, item .1024); guidelines of the Inspector General for Personal Data Protection; Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

The Administrator appropriately provides, for example, the following technical measures to prevent unauthorized persons from obtaining and modifying Personal Data sent electronically:

  • Securing the data set against unauthorized access.
  • SSL certificate on the Online Store pages where Personal Data is provided.
  • Encryption of data used to authorize a person using the functionality of the Online Store.
  • Access to the Account only after providing an individual login and password.

III. What personal data do we collect, what is the purpose and duration of their storage.

  • Registration in the online store

  • If, when placing an order, the Customer chooses delivery to an address other than the one indicated when registering or placing the order, please additionally provide:
  • name and surname or name of the company/institution – necessary for us to address the parcel.
  • address (street, house number/or house and apartment number, postal code, and city) – necessary to address the parcel.
  • telephone number of the recipient of the shipment – necessary when selecting some delivery methods (required by carriers).
  • If, when placing an order, the Customer chooses to issue a sales document with data other than those indicated during registration or placing the order, please additionally provide:
  • name and surname or name of the company/institution – necessary to issue a sale receipt.
  • address (street, house number/or house and apartment number, postal code and city) – necessary to issue a sale receipt.
  • The data provided when placing an order is processed by www.silvercoinseurope.com and the following entities to the extent specified below: name and surname, address, telephone number, e-mail address indicated as the delivery address are provided to shipping companies in the form of a label/waybill, which is also an order to deliver the shipment, depending on the type of shipment selected.
  • name and surname, address, NIP indicated as the data for which the sales document is to be issued are transferred in the form of a sales document to the accounting system: If you make a payment using an external payment system, all data provided after going to the payment operator’s website remains registered only in its database and is in no way available or stored by silvercoinseurope.com currently does not cooperate with any payment operators.

The data is stored for a period of 5 years from the end of the calendar year following the year in which the sales document was issued, in accordance with the applicable regulations governing the storage period of accounting documents.
